Abstract

This volume pushes forward the analysis carried out in the companion book on “EU Fundamental Freedoms and private law”. It is focused on the difficult problems raised by the interaction between EU fundamental rights – beyond the limited dimension of EU economic freedoms – and national law, with specific regard to private law. The issue of horizontal effect of fundamental rights is approached from an interdisciplinary and multilevel perspective, studying in particular the most recent case law of the European Court of Justice and of the European Court of Human Rights, with the aim of understanding its impact on the evolution of national private law.
