Abstract

During the last few decades, several aspects of legal reasoning have been subjected to intense jurisprudential scrutiny – among these, the structure of legal interpretation, the role of logic and rhetoric in interpretive discourse, the logic of evidence… But a vast terra incognita is still left unexplored. And, while important theoretical work has already appeared on the subject, it seems that much still needs to be discussed even about the ‘classic’ topics in the theory of legal reasoning. And of course new theoretical issues and perspectives claim our attention, also in connection to the recent developments in cognitive sciences and in the new technologies. This book is the first of series devoted to the new, challenging topics in the theory of legal reasoning, with a multidisciplinary approach.
