Abstract
I due testi di Giorgio Lazzaro che qui sono nuovamente pubblicati comparvero il primo nel 1970, con il titolo Argomenti dei giudici, e il secondo nel 1979, con lo stesso titolo, ma con l’aggiunta del sottotitolo Il linguaggio comune. Entrambi appartengono a quella manciata di opere di Lazzaro cui ancora si fa talvolta riferimento nelle pagine dell’odierna teoria del diritto e dell’interpretazione giuridica. Emerge qui un’idea relativa ai compiti della filosofia o della teoria del diritto, secondo cui queste discipline dovrebbero abbandonare gli infruttuosi tentativi di catturare essenze, ovvero di cogliere la “natura” sfuggente dei concetti giuridici, e indagare invece sul concreto operare dei giudici, ovvero sui modi in cui essi effettivamente utilizzano questi concetti e sulle finalità per cui li utilizzano, tramite una ricostruzione, successiva a un’indagine empirica sulle argomentazioni interpretative dei giudici, dei modi in cui costoro intendono e praticano le loro attività interpretative e applicative.
The two works by Giorgio Lazzaro republished here first appeared in 1970, with the title Argomenti dei giudici, and in 1979, with the same title but with the addition of the subtitle Il linguaggio comune. Both works belong to that handful of works by Lazzaro that are still sometimes referred to in the pages of today’s scholarly literature in legal theory and legal interpretation. What emerges here is an idea concerning the tasks of philosophy or legal theory, according to which these disciplines should abandon fruitless attempts to capture essences, or to grasp the elusive ‘nature’ of legal concepts, and should instead investigate the actual work of judges, or the ways in which they actually use these concepts and the purposes for which they use them, through a reconstruction, following an empirical investigation of the interpretative arguments of judges, of the ways in which they understand and practice their interpretative and applicative activities.
